Noida District Magistrate Approaches Supreme Court After High Court Sets Aside NSA Detention

Thedeshpost.com – Gautam Budh Nagar district magistrate Medha Roopam has approached the Supreme Court after the Allahabad high court sharply criticised the detention of student protester Akriti Chaudhary under the National Security Act.

The move follows the high court’s decision to invalidate the detention order against Chaudhary, 25, who had been taken into custody in connection with a workers’ protest in Noida in April. The court ordered that she be released immediately unless she was required to remain in custody in another case.

High Court Rejects Detention Order

The Allahabad high court concluded that the case used to justify Chaudhary’s detention rested on a narrative it described as “concocted” by the state. Its ruling set aside the use of the National Security Act in her case, bringing renewed focus to the standards authorities must meet before invoking the preventive-detention law.

Preventive detention allows a person to be held on the basis of an assessment that action may be needed to prevent a threat to security or public order. Because it can restrict liberty without the usual course of a criminal trial, courts closely examine whether the material supporting such detention is credible, relevant and sufficient.

In Chaudhary’s case, the high court found the detention order could not stand. It also directed that Rs 5 lakh be recovered from Roopam’s salary as compensation.

Directions on Service Records

Beyond quashing the detention, the court ordered that its displeasure with the district magistrate and police officers involved in preparing the dossier be entered in their service records. A detention dossier is a key document placed before authorities to support the decision to invoke the NSA, making its preparation central to the legality of the action.

The ruling delivered unusually strong observations about the responsibility of public officials. The court warned that continued “despotic” conduct by “errant” members of the bureaucracy could turn Uttar Pradesh into an Orwellian dystopia.

“Loyalty is towards the constitution and not the political executive”.

The court underlined that officials exercise authority within constitutional limits and cannot treat administrative power as unchecked. It also emphasised the democratic relationship between the state and citizens.

Officers are servants who serve the people, who are “the masters in a democracy”.

Supreme Court Challenge

Roopam’s approach to the Supreme Court comes shortly after the high court’s order. On September 9, Solicitor General Tushar Mehta told the apex court that an appeal would be filed against the ruling that had cancelled Chaudhary’s detention order.

The Supreme Court challenge will place the high court’s conclusions before the country’s highest court. The matter is likely to involve scrutiny of both the facts used to justify the detention and the legal principles governing the use of the National Security Act in circumstances linked to public protests.

The case also highlights the distinction between allegations connected to a protest and the separate question of whether preventive detention is legally justified. Authorities may take action where the law permits, but detention under the NSA requires a demonstrable basis that satisfies the safeguards built into the legal framework.

Why the Case Matters

The dispute has broader significance because it concerns the exercise of executive authority over a student involved in protest-related events. The high court’s order did not merely provide relief to Chaudhary; it also raised questions about official accountability when detention powers are used on the basis of material later found to be unsustainable.

Its directions regarding compensation and service records signal that courts can impose consequences where they find serious failures in the decision-making process. At the same time, the appeal to the Supreme Court means the legal issues remain open for further examination.

For Chaudhary, the immediate effect of the high court ruling was an order for her release unless another case independently required her custody. For the administration, the Supreme Court petition offers an opportunity to contest the findings that led to the detention order being struck down.

The eventual outcome will be watched for its implications on the use of preventive-detention powers, the preparation of police and administrative records, and the constitutional duty of officials when responding to demonstrations and public-order concerns.
